【新草案】公司或可禁止宗教歧视言论

在新建议的反宗教歧视草案下,任何公司或机构可阻止雇员发表令其蒙受商业损失的歧视性言论。

联邦律政部长波达(Christian Porter)表示,反宗教歧视条例的新草案能帮助有宗教信仰的人免遭歧视。

今年早前,澳洲星级榄球员佛劳(Israel Folau)因被澳洲榄球协会解除合约而提出法律诉讼,当局希望新草案能解决类似的案件。佛劳曾在社交媒体多次发表有关男同性恋者的宗教言论,在新草案下,澳洲榄球协会必须解释所蒙受的商业损失,才可合理解雇他。
联邦政府昨日公布新草案,目的旨在保障宗教人士免遭歧视,但不容许他们反过来歧视他人。该草案与现行的反歧视法例相类似,涵盖包括年龄、种族和残障歧视。

联邦律政部长波达昨日在雪梨大犹太会堂致辞时公布有关草案,指法律是最有效的防卫「盾牌」,而非赋予「佩剑」攻击他人。他又说:「合理表达言论的权利是一把利剑,但总是两面刃」。

达部长表示,大机构将来可对同类情况采取行动。他解释道,与佛劳有类似情况的人,可以提出将他解雇是不合理的间接歧视。雇主有权反驳,但必须证明他们的机构因该行为而蒙受商业损失。

佛劳已采取法律行动,指控澳洲榄球协会及新州Waratahs球队不公平解雇他。
